شروط الاستخدامTerms of Service

باستخدامك منصة Moment («المنصة») فإنك توافق على هذه الشروط. إن لم توافق عليها، يُرجى عدم استخدام المنصة.By using the Moment platform ("the Platform") you agree to these terms. If you do not agree, please do not use the Platform.

1) وصف الخدمة1) Service description

توفّر Moment أدوات لخدمة عملاء الأنشطة التجارية على واتساب عبر موظف ذكاء اصطناعي، وإدارة المحادثات والحملات، عبر WhatsApp Business Platform الرسمي من Meta.Moment provides tools for businesses to serve customers on WhatsApp via an AI employee, and to manage conversations and campaigns, through Meta's official WhatsApp Business Platform.

2) الحساب والأهلية2) Account & eligibility

• يجب أن تكون مالكاً لنشاط تجاري أو مفوّضاً بالتصرف عنه.You must own a business or be authorized to act on its behalf.
• أنت مسؤول عن صحة بيانات حسابك والحفاظ على سرية كلمة المرور.You are responsible for the accuracy of your account data and keeping your password confidential.
• أنت مسؤول عن كل النشاط الذي يحدث ضمن حسابك.You are responsible for all activity that occurs under your account.

3) الاستخدام المقبول3) Acceptable use

تتعهد بعدم استخدام المنصة في:You agree not to use the Platform for:

• إرسال رسائل عشوائية (سبام) أو لعملاء لم يمنحوا موافقتهم.Sending spam or messaging customers who have not opted in.
• أي محتوى مخالف للقانون أو لسياسات Meta وواتساب للأعمال.Any content that violates the law or the Meta and WhatsApp Business policies.
• التحايل أو إساءة استخدام الخدمة بأي شكل يضر بالمنصة أو بالآخرين.Abusing or misusing the service in any way that harms the Platform or others.

أي مخالفة لسياسات واتساب للأعمال قد تؤدي إلى تعليق الحساب.Any violation of the WhatsApp Business policies may result in account suspension.

4) الموظف الذكي4) The AI employee

الموظف الذكي يرد اعتماداً على المعلومات التي يوفّرها التاجر (الكتالوج وملف المعرفة). التاجر مسؤول عن دقة هذه المعلومات. تبذل المنصة جهدها لمنع الردود غير الدقيقة، لكنها لا تضمن خلوّ الردود الآلية من الأخطاء.The AI employee replies based on information provided by the merchant (catalog and knowledge base). The merchant is responsible for the accuracy of this information. The Platform strives to prevent inaccurate replies but does not guarantee that automated replies are error-free.

5) الاشتراك والدفع5) Subscription & payment

• الاشتراك شهري حسب الباقة المختارة، ويبدأ بعد انتهاء الفترة التجريبية المجانية.Subscription is monthly per the selected plan and begins after the free trial ends.
• رسائل الحملات تُحتسب حسب الاستخدام وتُخصم من رصيد التاجر.Campaign messages are billed by usage and deducted from the merchant's wallet.
• يمكن إلغاء الاشتراك بأي وقت، ويستمر حتى نهاية الدورة المدفوعة.You may cancel anytime; access continues until the end of the paid cycle.

6) الملكية الفكرية6) Intellectual property

جميع حقوق المنصة وبرمجياتها وعلامتها التجارية مملوكة لـ Moment. تبقى بيانات ومحتوى التاجر ملكاً له.All rights to the Platform, its software and trademark are owned by Moment. The merchant's data and content remain their property.

7) إخلاء المسؤولية7) Disclaimer

تُقدَّم الخدمة «كما هي». لا نتحمل المسؤولية عن الأضرار غير المباشرة الناتجة عن استخدام المنصة، أو عن انقطاع خدمات أطراف ثالثة (مثل واتساب/Meta) خارجة عن سيطرتنا.The service is provided "as is". We are not liable for indirect damages arising from use of the Platform, or for interruptions of third-party services (such as WhatsApp/Meta) beyond our control.

8) التعديلات والإنهاء8) Changes & termination

قد نُعدّل هذه الشروط أو الخدمة مع إشعار معقول. ويحق لنا تعليق أو إنهاء أي حساب يخالف هذه الشروط أو سياسات واتساب.We may modify these terms or the service with reasonable notice. We may suspend or terminate any account that violates these terms or the WhatsApp policies.

9) القانون المطبّق9) Governing law

تخضع هذه الشروط لأنظمة دولة الكويت.These terms are governed by the laws of the State of Kuwait.
